Pro Bono Clients Win Sixth Circuit Affirmance of Pre-Trial Detention COVID-19 Safety Consent Decree

Paul, Weiss, along with co-counsel from the ACLU, ACLU Tennessee, and Just City, achieved a significant victory in the Sixth Circuit on behalf of a class of all current and future medically vulnerable detainees in pre-trial detention at the Shelby County Jail in Tennessee.
The Sixth Circuit unanimously affirmed the district court’s denial of the jail’s motion to terminate a consent decree, which was negotiated by counsel for the ACLU, including Paul, Weiss, in 2021, that imposes various obligations on the jail regarding its response to the COVID-19 pandemic. The consent decree requires the jail to comply with various inspection and reporting requirements; maintain safe ventilation and air quality; implement various testing, isolation and quarantine protocols; provide hygiene, personal protective equipment and vaccines; and implement social-distancing requirements.
