Workers’ Compensation for Essential Employees Who Contract COVID-19

Under emergency rules, COVID-19 first responders or front-line workers who contract COVID-19 during the state of emergency will be presumed eligible for workers’ compensation claims.

The emergency rules cover individuals employed as police, fire personnel, emergency medical technicians, and paramedics; all individuals employed and considered as first responders, health care providers engaged in patient care, and corrections officers; and crucial personnel working in essential services, including grocery stores, pharmacies, food and beverage production, organizations that provide charitable and social services, gas stations, financial institutions, hardware and supply stores, educational institutions, laundry services, restaurants, transportation, home-based care and services, residential facilities and shelters, professional services, day care centers, critical labor union functions, hotels and motels, funeral services, and manufacture, distribution, and supply chain for critical products and industries.

Employees who are injured at work should inform their employer, including the approximate date and place of the injury, if known, as soon as is practicable, and no later than 45 days after the accident.
