Description of Program and Relief

Requirement for Employers to File Partial Unemployment Claims

In response to the COVID-19 pandemic, the Georgia Department of Labor (GDOL) has mandated that all Georgia employers file partial claims online on behalf of their employees for any week during which an employee (full-time/part-time) works less than their usual hours due to a partial or total company shutdown caused by the COVID-19 public health emergency. The mandate will remain in effect for 120 days or until the agency proposes or adopts a subsequent rule.

Georgia employers are required to file partial claims on behalf of their full-time and part-time employees for any week when it is necessary to temporarily reduce work hours, or for any week where there is no work available for a short period and the employee earns an amount not exceeding their maximum weekly benefit amount plus $50. Employees receive unemployment insurance benefit payments quicker when employers file partial claims on their behalf. This requirement applies to partial or total company shutdowns caused by the COVID-19 public health emergency.

Generally, under the mandate, all employer-filed partial unemployment claims filed on or after March 15, 2020:

1. Must be filed by employers online in the Employer Portal available here; and

2. Must be filed by employers with respect to any week during which a full- or part-time employee’s hours are reduced due to a partial or total company shutdown caused by the COVID-19 public health emergency.

Additionally, the Emergency Rules state that any employer found to be in violation must pay to the Commissioner the full amount of benefits paid to the employee.

Employees for whom a partial claim has been filed are NOT required to report to a GDOL career center, register for employment services, or look for other work.
