Description of Program and Relief
Workers’ Compensation Board Provides Certain Relief From Requirements for Obtaining Benefits for Claimants in Response to Coronavirus Outbreak
The Workers’ Compensation Board (the “Board”) has announced that it will conduct all hearings remotely, through the Board’s Virtual Hearings. The Board also announced the following relief for claimants in connection with WCB claims:

Claimants are excused from the 90-day requirement that their attending medical provider provide progress reports of ongoing medically necessary treatment in order for the claimant to claim benefits if the failure to secure a medical report is due to the coronavirus outbreak.

The Board will also excuse a failure to attend an independent medical examination (“IME”), which would normally bar recovering compensation, where the failure to attend is due to the coronavirus outbreak. A claimant should let his or her attorney know, and notify the IME doctor and the Board by email at wcbclaimsfiling@wcb.ny.gov, or by letter to the Board's centralized mailing address at PO Box 5205, Binghamton, NY 13902-5205. -
The Board will also consider using its discretion to excuse an untimely filing for appeals and rebuttals where the reason for such delay is due to circumstances directly related to the coronavirus.

Suspended until further notice the requirement for original handwritten signatures on certain forms, which require the signatures of claimants, attorneys, payers and administrators, during the current state of emergency.

The Board is not requiring claimants to demonstrate that they are attached to the labor market, i.e. conducting a job search or participating in job placement or vocational rehabilitation, in order to maintain partial disability payments.
