A counsel in the Litigation Department, Peter Carey is a member of the firm’s Cybersecurity & Data Protection and White Collar & Regulatory Defense groups. His practice focuses on advising clients on sensitive cyber and national security matters, as well as global risk and crisis management. Peter routinely advises clients on all aspects of breach preparedness and response, including counseling boards and executives on cybersecurity governance and risk management, and responding to cyber incidents ranging from ransomware to nation-state sponsored attacks. He regularly navigates delicate and high-profile matters involving multi-jurisdictional investigations, congressional oversight and significant media attention.
EXPERIENCE
Peter has deep experience in cybersecurity counseling and investigations, including advising on U.S. and international laws related to digital crime, data security and privacy. He advises companies across industries—from technology and health care to national defense and financial services—in connection with cyber incidents. Peter’s experience includes managing and advising on:
- Internal and forensic investigations;
- Containment, eradication and recovery;
- Coordination with law enforcement;
- Crisis communications;
- Regulatory and contractual notification obligations; and
- Inquiries from customers, auditors, insurers, data protection authorities, state attorneys general and other stakeholders.
He also advises clients on strategies to mitigate cyber and legal risk before an incident occurs. Peter regularly works with clients to develop and improve incident response, ransomware, and crisis management policies and procedures; partners with clients and leading cybersecurity firms to conduct and evaluate the results of cybersecurity testing and risk assessments; and delivers cybersecurity tabletop exercises and briefings to business teams, executives and boards of directors.
Peter leverages his significant private sector experience counseling clients on a wide variety of cyber and national security issues, including questions arising under the Electronic Communications Privacy Act (ECPA), Computer Fraud and Abuse Act (CFAA), Cybersecurity Act of 2015 and Foreign Agents Registration Act (FARA). With respect to FARA, Peter has advised clients across a broad array of industries on designing, implementing and reviewing the effectiveness of global compliance programs tailored to individualized risk-based assessments.
Prior to joining Paul, Weiss, Peter was a member of the privacy and data security group for a leading international law firm and served as senior counsel to Sen. Orrin G. Hatch on the U.S. Senate Committee on the Judiciary. During his time with the Committee, Peter advised Sen. Hatch on a multitude of complex issues involving criminal law, cybersecurity and oversight, and was integral to negotiating and drafting numerous pieces of legislation.
Peter received his J.D. from Georgetown University Law Center, where he served as articles editor for the Georgetown Journal of International Law. He also served as a Law Fellow and Senior Writing Fellow in Georgetown’s legal writing program. During law school, Peter interned at the U.S. Department of Justice in both the National Security Division and the Criminal Division’s Fraud Section. Peter earned his M.A. in Security Studies from Georgetown University and his B.A. in Government in the Plan II Honors Program from the University of Texas at Austin.
Peter is a Certified Information Privacy Professional/United States (CIPP/US) through the International Association of Privacy Professionals (IAPP).
