In the latest issue of the Restructuring Department Bulletin, we highlight several recent developments in the restructuring area, including a Fifth Circuit opinion vacating and remanding the bankruptcy court’s refusal to abstain from adjudicating claims against ERCOT arising from winter storm Uri; a district court’s denial of a request for discretionary appeal of the bankruptcy court’s order permitting discovery of Boeing Company in the chapter 15 case of Comair Limited; and a Seventh Circuit decision holding that federal, rather than state law defines the meaning of “transfer” for preference purposes.
