Victory on Summary Judgment for Pro Bono Client
- Client News
- December 15, 2014
Paul, Weiss achieved a significant victory for pro bono clients
Fund for the Public Interest and the Massachusetts Public Interest
Research Group in litigation pending before Judge Roman in the
Southern District of New York. Judge Roman granted the Funds'
summary judgment motion and dismissed breach of contract claims
through which the plaintiff had alleged over half a million dollars
in claimed damages.
The case arose after our clients terminated an exclusive agency
agreement with the company that they had used to process credit
card transactions, CHI. CHI claimed that the Funds did not
have a basis to terminate the agreement. On summary judgment,
Judge Roman agreed with our proposed contractual interpretation,
determined that the Funds had adequate grounds for terminating the
relevant agreement, and dismissed the case.
