Pro Bono Client Wins Unemployment Insurance Appeal

Paul, Weiss obtained a victory for a pro bono client when an administrative law judge reversed the Department of Labor's initial determination that had disqualified our client from receiving unemployment benefits. Our client was accused of falsifying records, which is misconduct that would disqualify her from receiving benefits. Paul, Weiss successfully argued that the employer's six-week delay between discovery of the alleged falsification and our client's discharge implied that there was no direct temporal nexus between the incident and the termination, and therefore that our client was not terminated due to disqualifying misconduct. Pending appeal, our client will receive her unemployment benefits retroactively starting from November 4, 2014.
