Pro Bono Client Wins Unemployment Benefits Appeal

Paul, Weiss won an appeal before the State of New York Unemployment Insurance Appeal Board, obtaining a decision that a pro bono client who lost her job was entitled to receive unemployment benefits. After our client lost her job and began receiving unemployment benefits, her employer contacted the Department of Labor, claiming she had resigned from her job and had misrepresented the reason for her departure to the department. Last fall, an administrative law judge sided with the employer and ruled our client ineligible for benefits. On appeal, the State of New York Unemployment Insurance Appeal Board overruled the decision of the administrative law judge, holding that our client did not resign and was in fact terminated, and was therefore entitled to receive unemployment benefits.
