Pro Bono Client Wins De Novo Challenge of Bail Determination

Paul, Weiss, acting as co-counsel with Brooklyn Defender Services, successfully argued a de novo writ before the New York Supreme Court, Kings County to alter a bail determination from the criminal court. The court overturned the criminal court's bail determination of a $3,500 bond or $3,500 cash and released our 16 year-old client on his own recognizance, finding that no amount of bail was required to ensure his future appearance in court. Paul, Weiss argued under the New York bail statute that our client is a 16-year-old high school student living with his parents, has no criminal record, is unlikely to face any jail time on this charge and has no financial resources to afford bail. The district attorney made arguments about the seriousness of the crime and the client's juvenile record. However, the court ultimately determined that the district attorney had not sufficiently shown that our client was a flight risk.
