Pro Bono Client Obtains Victory in VOLS Unemployment Insurance Case

Paul, Weiss obtained a victory in an unemployment insurance case with pro bono partner Volunteers of Legal Service (VOLS). As a participant in the VOLS Unemployment Insurance Advocacy Project, the firm represents clients whose employers have objected to their receipt of unemployment insurance benefits.
In this most recent case, the New York State Department of Labor had denied the claimant unemployment benefits based upon a finding that she was terminated for misconduct. The Department found that the claimant, who worked for a medical records company, had refused to complete her work scanning records at a doctor's office and left without notifying her employer. The administrative law judge, however, determined that the credible evidence showed that the claimant had been directed to leave before completing her work by her supervisor, whom the claimant had informed when she left the office. The judge overruled the Department's decision about misconduct and allowed the claimant benefits dating back to the day of her termination.
