Pro Bono Client Obtains Victory in Family Court Trial

Paul, Weiss obtained a significant trial victory when the New York Family Court dismissed all abuse and neglect charges filed against our client and her partner following the death of their infant son in October 2012. Following the infant's death, his twin sister was removed from their home by ACS. The Office of the Medical Examiner ruled the infant's death a homicide, concluding that he had suffered from shaken baby syndrome. Accepting without exception the medical opinions of our experts, the court concluded unequivocally that the baby had died from a rare condition of blood clots in the brain, cerebral sinovenous thrombosis, a finding that had been wholly overlooked by the medical examiner on autopsy. The court further found that the infant's parents had done everything within their power to obtain medical care for him in the days and weeks leading up to his death.
This was the culmination of a trial spanning two years, with over 30 trial days and 14 witnesses, in which Paul, Weiss served as co-counsel with The Bronx Defenders.
