Pro Bono Client Obtains Vacatur of Summary Judgment Order

Paul, Weiss achieved a victory for our pro bono client when the
Second Circuit vacated an order of the United States District Court
for the Western District of New York, Larimer and Telesca, granting
summary judgment in favor of prison officials who allegedly
committed due process violations and retaliated against our client
for asserting his First Amendment rights.
Our client alleged that prison officials filed a false misbehavior
report in retaliation for his filing of grievances against certain
corrections officers. He further alleged that while being confined
in a special housing unit pursuant to the charges, prison officials
failed to provide him adequate assistance for his disciplinary
hearing and concealed an exculpatory letter they received from an
inmate requesting to testify at our client's disciplinary hearing.
The Second Circuit concluded that there are disputed issues of fact
and vacated the order granting summary judgment and remanded the
case.
