Pro Bono Client Obtains Favorable Decisions in Prisoner's Rights Case

Judge Katherine Forrest of the Southern District of New York issued three decisions in favor of our client, who has brought Section 1983 claims against the City of New York and various corrections officers for a vicious beating he suffered at the Bronx Criminal Court while he was awaiting arraignment, in retaliation for asking repeatedly for his bronchitis medication. First, Judge Forrest denied the defendants' motion to dismiss. She rejected both their argument that the plaintiff had failed to state viable claims against the city for municipal liability based on the plaintiff's allegations of a pattern and practice of the use of excessive force and their argument that the plaintiff's claims against the correction officer who ordered the beating was time-barred. Second, Judge Forrest granted the plaintiff's motion to compel discovery on the plaintiff's municipal liability claims, after already having denied several requests by the defendants to delay discovery on the municipal liability claims. Third, Judge Forrest granted the plaintiff's motion to compel discovery aimed at identifying several John Doe defendants who beat the plaintiff while in riot gear.
