Paul, Weiss Wins Dismissal of Complaint Against Pro Bono Client
On September 13, Paul, Weiss successfully obtained the dismissal of all claims, with prejudice, against a victim of domestic violence who was being sued in the Southern District of New York. Our client, who was referred to us by Sanctuary for Families, was alleged to have committed various torts against her ex-husband in connection with his prior criminal prosecution, including intentional and negligent infliction of emotional distress, malicious prosecution, false imprisonment, trespass on the person, and conspiracy with government entities to violate his civil rights. Paul, Weiss lawyers prepared a brief in support of our client's motion to dismiss which demonstrated that the plaintiff's complaint failed to state a claim under the Federal Rules of Civil Procedure. Prior to filing the brief, Paul, Weiss engaged with the plaintiff's counsel and convinced him that his client's claims lacked all merit and were borderline frivolous based on the relevant substantive law and various statutes of limitations. As a result, the plaintiff filed a notice of voluntary dismissal with prejudice of all claims against our client.
