Paul, Weiss Obtains Victory for Pro Bono Client in VOLS Unemployment Insurance Case

Paul, Weiss obtained a victory in an unemployment insurance case with pro bono partner Volunteers of Legal Service (VOLS). As a participant in the VOLS Unemployment Insurance Advocacy Project, the firm represents clients whose employers have objected to their receipt of unemployment insurance benefits.
In this most recent case, the New York State Department of Labor had denied the claimant unemployment benefits based on a finding that he was suspended for misconduct. The Department found that the claimant, a school bus driver, had failed to report an incident in which a student was hit by a car after exiting his bus. The administrative law judge, however, determined that the credible evidence showed that the claimant had neither seen the accident nor willfully failed to report it. The judge overruled the Department's decision on misconduct and allowed the claimant benefits dating back to the day of the incident.
The matter was handled by summer associate Joshua K. Goldman, and was supervised by litigation partner David W. Brown and associate Luke X. Flynn-Fitzsimmons.
