Paul, Weiss Client Successfully Challenges Parole Denial

Paul, Weiss won an Article 78 challenge on behalf of a pro bono client. Our client, who has been incarcerated for nearly 44 years for crimes he committed when he was 19 years old, sought to overturn a decision by the New York State Parole Board denying him parole for the 11th time. In a hearing in New York Supreme Court, Albany County, the Paul, Weiss team argued that the parole board’s decision-making—which focused on his crimes and purported community “opposition” in his file that the parole board disclosed neither to our client nor to the court—was improper and unsupported in the record. In granting our client’s petition, the court held that the administrative record could not support the board’s decision, and ordered that he be given a new parole interview within 45 days.
