Paul, Weiss Achieves Pro Bono Victory in Second Department

The New York Appellate Division affirmed a Family Court decision vacating a neglect finding made against a Paul, Weiss pro bono client.
In July 2015, the Administration for Children's Services (ACS) commenced an action against our client, alleging neglect of her infant son. Three months later, the Family Court determined that there had been neglect, releasing our client’s son to her care and imposing a year of supervision. In May 2016, all parties consented to ending supervision five months early because there were no longer any child protective concerns. In December 2016, the court granted our client's motion to vacate the neglect finding. ACS nonetheless appealed.
On appeal, Paul, Weiss and co-counsel the Brooklyn Defenders argued that good cause existed to vacate the neglect finding because our client had ameliorated the circumstances that precipitated it. The Appellate Division, Second Department, agreed, unanimously affirming the Family Court’s decision.
