Kannon Shanmugam Profiled in The American Lawyer Following Back-to-Back Appellate Arguments

Litigation partner Kannon Shanmugam was profiled in The American Lawyer’s “Litigation Daily” on March 22. In “Two Days. Two Circuits. Two Arguments. 1,100 Miles,” Kannon spoke about the logistical and professional challenges of preparing for two back-to-back oral arguments. In the first appeal on March 15 before the Eighth Circuit in St. Paul, Minnesota, Kannon urged the court to have climate change litigation against Exxon decided in federal rather than state court; a day later, he asked the Second Circuit to sign off on a $5.5 billion settlement reached by Mastercard in an antitrust suit over interchange fees charged on card purchases.
Kannon discussed his normal preparation for oral argument and adjustments he made to account for the quick turnaround between the two cases. The most important preparatory step, he noted, were the multiple, alternating moot courts during the week prior to the oral arguments. Because the cases were so close together, “it was actually really important to bounce back and forth between the two cases and really to be preparing for them simultaneously.”
