Litigation partners Bill Isaacson, Meredith Dearborn, Brette Tannenbaum and Randy Luskey were recognized in The American Lawyer’s September 20 “Litigation Daily” column for their appellate victory on behalf of International Swimming League in its antitrust lawsuit against World Aquatics, the sports federation administering international competitions in water sports. A Ninth Circuit panel unanimously reversed the trial court’s summary judgment decision dismissing ISL’s lawsuit and remanded the case for further proceedings. Among other things, the appellate court held that awarding summary judgment to the defendant was improper because we had created a triable issue around whether World Aquatics’ rules constituted a per se unlawful group boycott by preventing member federations and swimmers from doing business with ISL without risking “draconian sanctions.”
