Litigation partner Kannon Shanmugam discussed various aspects of Supreme Court advocacy on the October 13 episode of the Texas Appellate Law Podcast. In the episode, “Practicing Before the U.S. Supreme Court,” Kannon covers a broad range of topics, including the differences between arguing before the Supreme Court and arguing before other appellate courts, the differences between the certiorari and merits stages, the development of the next generation of appellate advocates, Supreme Court pro bono advocacy, and other topics.
“The Supreme Court is not bound by precedent” as other appellate courts are, Kannon observes. “So, you want to be framing your arguments in terms of what the Supreme Court has previously said, but ultimately you want to convince the Supreme Court that you’re right as a matter of first principles.”
