Paul, Weiss Wins Circuit Court Victory Upholding Arbitration Award

On March 8, Paul, Weiss obtained a victory for client Tube City IMS, LLC, in an appeal brought by Duferco, S.A. in the U.S. Court of Appeals for the Second Circuit. The appeal stemmed from an arbitration brought by Duferco concerning the quality of a cargo of scrap steel purchased from Tube City. Following a decision in Tube City's favor, Duferco sought to vacate the award on the ground that the arbitrator had committed misconduct in refusing to admit certain evidence.
After Judge Jed Rakoff of the SDNY denied the petition to vacate and confirmed the award, Duferco appealed to the Second Circuit. Litigation partner David Brown argued the appeal on March 5 and the court issued a summary order affirming the district court's ruling three days later.
