Litigation partners Joe Simons and Aidan Synnott's article, "Recent DC Circuit decisions in Whole Foods leave standard for future mergers unsettled," was published in the February 2009 issue of Competition Law International. The article discusses the implications of recent rulings regarding a proposed merger of Whole Foods and Wild Oats, respectively the U.S.'s largest and second-largest supermarket chains offering natural and organic products. The rulings leave ambiguous certain aspects of antitrust law. "Although the questionable precedential value of the opinion makes it highly unlikely that the U.S. Supreme Court will take certiorari," write the authors, "we believe it would be appropriate to do so or risk several years of confused and confusing FTC injunction applications." The article was co-written with Ilene Knable Gotts and George T. Conway III, partners at Wachtell, Lipton, Rosen & Katz.
