Paul, Weiss litigation partner Andrew Finch and Mastercard Senior Managing Counsel Peter Bernstein co-authored an article, “Effective Risk Assessments in the Evolving Antitrust Compliance Landscape,” in the December 2020 issue of Compliance and Ethics Professional Magazine, a publication of the Society of Corporate Compliance and Ethics. The authors discuss the DOJ’s recent policy changes regarding the treatment of corporate antitrust compliance programs in its enforcement decisions, and, in light of these changes, how companies should now approach the design and implementation of their compliance programs. The authors identify and discuss the key elements of an effective antitrust compliance program, including adequate compliance training and communication to employees at all levels, compliance incentives and discipline, antitrust risk assessments, and monitoring and reporting mechanisms, among other factors.
