Aidan Synnott and Dan Crane Publish Article in The CPI Antitrust Journal
August 12, 2010
Litigation partner Aidan Synnott and litigation counsel Dan Crane co-authored the article "The Supreme Court Invalidates State Restriction on Federal Class Actions in Shady Grove v. Allstate," which appears in the August 2010 issue of The CPI Antitrust Journal. The article discusses the recent decision in which the U.S. Supreme Court held that Federal Rule of Civil Procedure 23 trumps a state rule that forbids all class action relief based on a state statutory penalty, a ruling that bears implications for antitrust law. For instance, the same state rule at issue in Shady Grove also restricts class action relief under New York's antitrust provision, the Donnelly Act. Summer associate Peter Magnuson assisted in the preparation of the article.
