Joseph J. Simons Quoted on Antitrust Issues in AT&T/T-Mobile Merger
In an article discussing the Department of Justice's (DOJ) Wednesday court challenge to AT&T's $39 billion planned acquisition of T-Mobile USA, litigation partner Joseph J. Simons told The Wall Street Journal before the filing that the DOJ's primary test "is whether a merger causes prices to be higher than they otherwise would be." Mr. Simons also noted that this doesn't have to mean prices going up.
Even if prices are falling, and continue to fall, the question is whether they would have fallen materially more absent the merger. The article "On AT&T, U.S. Choose Law Over Politics" appears in the August 31 issue of The Wall Street Journal.
