Description of Program and Relief

Family Medical Leave Act (FMLA)

South Dakota’s existing FMLA program provides state employees leave to take care of oneself or a loved one because of a serious health condition. The South Dakota Department of Labor and Regulation is currently awaiting guidance from the U.S. Department of Labor on implementation of the Families First Coronavirus Response Act.

Eligibility Requirements/Restrictions

FMLA leave may be taken by eligible state employees. Eligible state employees must have been employed by the state for at least 12 months and performed at least 1,250 hours of service within the preceding 12-month period.
