Description of Program and Relief

Temporary Employment of Former or Retired Government Employees

For the duration of the Governor’s declared State of Emergency, the State has enacted legislation permitting the government to temporarily re-employ certain former or retired government employees (including as consultants or independent contractors) by exempting them from statutory limitations on their hours worked and earnings received.

Specifically, the legislation exempts (i) former government employees who have retired and who are receiving pensions or retirement allowances and (ii) former government employees whose employment terminated by reason of having attained an age specified by statute, regulation, or rule without being entitled to any pension or retirement allowance.
