Description of Program and Relief

Extension of Expiration Date for Notary Public Commissions

Governor Gavin Newsom has issued an executive order that, among others, extends the expiration dates for notary public commissions.

The Executive Order provides for a 60-day extension for any notary public whose commission has or had an expiration date between March 1, 2020 and July 6, 2020.

In addition, to establish satisfactory evidence of the individual appearing before them, notaries public may accept expired California drivers licenses and identification cards within 60 days of the expiration date, so long as the expiration occurred on March 1, 2020 or later. Notaries public should annotate in their journal that the expired driver’s license or identification card was accepted due to Executive Order N-63-20.

Eligibility Requirements/Restrictions

In order for a notary public to be eligible for a 60-day extension, the notary public must annotate on each notarial act completed during such extension the following: “The notary commission extended pursuant to Executive Order N-63-20.” In addition, the notary public must maintain a valid surety bond pursuant to Government Code section 8212 during such 60-day extension.
