Description of Program and Relief

Residential Eviction Moratorium

The San Jose City Council has enacted a temporary eviction moratorium for residential properties in San Jose. The moratorium prohibits evictions of residential tenants who are unable to pay rent because they have been impacted by the COVID-19 outbreak. The moratorium applies to rent due between March 17, 2020 and May 31, 2020.

The moratorium does not specify details regarding requirements for paying back the rent owed during the moratorium period.

The moratorium does not relieve renters of their obligations to pay rent or otherwise comply with the terms of their leases.

Eligibility Requirements/Restrictions

To qualify for relief, renters must demonstrate that they have been impacted by COVID-19, and that they have suffered a substantial loss of income due to COVID-19 or related emergency declarations by County, State, or federal agencies.

Renters are encouraged to collect documentation demonstrating their substantial loss of income such as a letter from an employer citing COVID-19 as a reason for reduced work hours or termination, paycheck stubs from before and after the COVID-19 outbreak, or bank statements from before and after the COVID-19 outbreak. Those who cannot provide such documentation should fill out this form.
