Description of Program and Relief

Eviction and Foreclosure Moratorium for Those Experiencing Financial Hardship from COVID-19, and Extension of Housing Assistance Deadlines

The San Diego County Board of Supervisors approved a temporary moratorium on residential and commercial evictions for the unincorporated areas of San Diego County for renters who have a financial hardship related to the COVID-19 outbreak. This moratorium does not waive or relieve tenants of their contractual obligation to pay unpaid rent that is due.

In addition, the Board of Supervisors approved a moratorium on foreclosures and foreclosure-related evictions in the unincorporated areas of the county. This moratorium does not waive or relieve homeowners of their contractual obligation to pay their mortgages.

The Board of Supervisors has also authorized the County Housing Authority to extend deadlines—to the extent those deadlines are within the County Housing Authority’s discretion—for housing assistance recipients and applicants to deliver documents related to their eligibility for housing programs.

Dates Available

Protections against evictions and foreclosures are effective retroactively from March 4, 2020 to June 30, 2020.

Renters. Renters who have provided appropriate notice and documentation (as detailed below) to their landlords will have up to three months from June 1, 2020 to pay any rent owed before the landlord may recover possession due to missed rent payments. If a renter remains unable to pay due to financial impacts related to COVID-19, the renter may provide the landlord with another notice and additional documentation in order to extend the payment date by one additional month.

Homeowners. The County's Chief Administrative Officer is instructed to work with financial institutions to halt foreclosures. Borrowers should contact their lenders directly to obtain information about steps the lender is taking to halt foreclosures.

Housing Assistance. The County Housing Authority has not yet announced further details relating to extending deadlines for housing assistance programs.

Eligibility Requirements/Restrictions

Renters. The moratorium on evictions will apply to renters in unincorporated areas within San Diego County whose income has been reduced or who have otherwise been substantially economically harmed by the COVID-19 pandemic. To demonstrate that they have been financially impacted by COVID-19, renters must establish all of the following: (i) a substantial decrease in household or business income, or substantial out-of-pocket medical expenses; (ii) the decrease in household or business or the out-of-pocket medical expenses must be caused by the COVID-19 pandemic, or by any local, state, or federal government response to the COVID-19 pandemic; and (iii) the decrease in household or business income or the out-of-pocket medical expenses must be documented in writing. Acceptable documentation may include, but is not limited to: letters from employers, financial statements, business records, a physician’s letter, bills, or a combination of these.

Housing Assistance. The Housing Authority has not yet announced requirements for extended deadlines for housing assistance programs.

Application Deadlines (If Applicable)

For the eviction moratorium to apply, a tenant must notify the landlord of the tenant’s inability to pay rent within 7 days after the rent is due. Notice must be given in writing. Within two weeks of providing notice, the tenant must provide the landlord with documentation or objectively verifiable information that the tenant is unable to pay rent due to financial impacts related to COVID-19.

The County Housing Authority has not yet announced new deadlines, if any, for housing assistance programs. Individuals can apply here to be added to the waitlist for housing assistance, if they have not already applied. Individuals can update existing applications here.
