Description of Program and Relief

Temporary Delay of Eviction Proceedings for Individuals Affected by COVID-19

Pursuant to Executive Order 2020-14, Governor Ducey has ordered that residential eviction action orders shall be temporarily delayed for certain individuals who are affected by COVID-19, unless a court determines that enforcement is necessary in the interest of justice. An individual who seeks relief from or delay in eviction must notify the landlord or property owner in writing with any available supporting documentation.

The Executive Order is in effect for 120 days. This moratorium does not relieve any obligation to pay rent or comply with any other obligation that an individual may have under a lease or rental agreement.

Eligibility Requirements/Restrictions

The Executive Order provides temporary relief from eviction proceedings when one of the following circumstances exists:

(a) The individual tests positive for COVID-19 and is required to be quarantined;

(b) The individual is ordered by a licensed medical professional to self-quarantine;

(c) The individual is required to be quarantined based on someone in the home testing positive for COVID-19;

(d) The individual has a demonstrated health condition which makes them more at risk for COVID-19;

(e) The individual suffered a substantial loss of income as a result of the COVID-19 outbreak.
