Priyata Patel is a partner in Paul, Weiss’s Washington, D.C., office and a member of the firm’s Patent Litigation practice. Priyata has represented clients in disputes before U.S. district courts, the U.S. Patent and Trademark Office (PTAB) and the U.S. International Trade Commission (ITC), and on appeal to the U.S. Court of Appeals for the Federal Circuit—oftentimes in concurrent litigations across multiple forums. Priyata has been involved in all aspects of case management and trial preparation, including claim construction, depositions, expert discovery and witness preparation at trial.

Priyata has experience in matters involving pharmaceuticals and medical device technologies, including biologics, small molecules, formulation, drug delivery, methods of treatment and surgical instruments.

EXPERIENCE

Priyata’s representative matters have included:

  • a pharmaceutical company in pending multidistrict litigation brought under the Biologics Price Competition and Innovation Act against six biosimilar manufacturers, and concurrent inter partes review (IPR) proceedings, relating to recombinant fusion protein for treatment of eye disease;
  • a pharmaceutical company in competitor patent and antitrust litigation across the ITC, district court, PTAB and the Federal Circuit regarding its blockbuster drug, including defeating a competitor’s attempt to obtain an exclusion order at the ITC and invalidating the asserted patent in an IPR final written decision that was affirmed by the Federal Circuit;
  • a pharmaceutical company in a post-grant review proceeding before the PTAB relating to a small molecule for the treatment of blood cancers;
  • a medical device company in co-pending ITC and IPR proceedings, district court litigation and corresponding appeals concerning cutting-edge surgical stapling technology;
  • a chemical company in an ITC proceeding against a competitor relating to crystalline modifications of pyraclostrobin used for crop protection;
  • a pharmaceutical company in district court litigation and IPR proceedings relating to insulin formulations and delivery devices;
  • a genetics testing company in district court patent litigation related to diagnostic molecular testing;
  • an e-vapor product manufacturer in district court litigation with competitors over e-vapor and smoking cessation technology that resulted in a jury verdict awarding the company $95 million in damages for past infringement of its patents, as well as ongoing royalties;
  • a software technology company in a competitor dispute involving Delaware and Georgia patent lawsuits relating to speech recognition technology;
  • a software technology company in a Federal Circuit appeal after dismissal under Section 101 of a patent infringement suit relating to medical imaging technology, resulting in a precedential opinion affirming the district court’s dismissal; and
  • a network security company in district court patent litigation relating to firewalls and managed security monitoring services.
