October 19, 2022 Download PDF
In the latest issue of the Restructuring Department Bulletin, we highlight recent decisions impacting the restructuring arena, including a district court decision affirming that the safe harbor provision of Section 546(e) of the Bankruptcy Code applies to avoidance claims under foreign law in a Chapter 15 case; a Ninth Circuit decision holding that, in a solvent debtor case, unsecured creditors have an equitable right to postpetition interest at the applicable contractual or state law rate in order to be deemed unimpaired; and a Supreme Court ruling vacating a Second Circuit judgment directing the refund of unconstitutional Chapter 11 trustee fees. We also highlight the pro bono work of Paul, Weiss restructuring attorneys to help alleviate New York City taxi medallion owners’ debt burden.
