Real estate partners Mitchell Berg and Peter Fisch’s latest transactional real estate column, “The Perishable Agricultural Commodities Act,” was published in the February 14 issue of the New York Law Journal. The authors discuss how the Perishable Agricultural Commodities Act (PACA), enacted to protect the interest of suppliers and sellers of perishable agricultural commodities, has become a matter of some concern to title insurance companies and lenders in loan transactions involving borrowers that purchase significant amounts of produce.
