Real estate partners Meredith Kane and Harris Freidus published the article, "Lender Default: Borrowers Must Act Quickly to Replace Lost Funds," in the "Real Estate Trends" section of the October 29 New York Law Journal. The article discusses the tremendous financial stress major lending institutions are under in the current credit crisis and how this can impact borrowers of construction loans, who depend on timely funding of progress payment requisitions to keep a construction project moving ahead. The article also discusses the rights, remedies and obligations borrowers will have if their lenders become insolvent and fail to fund required loan advances.
