Mark Pomerantz Quoted on Harshness of U.S. Sentencing Guidelines
Litigation partner Mark F. Pomerantz was quoted in a Law360 article reporting on topics discussed at the New York City Bar Association's First Annual White Collar Crime Institute program. In April, the U.S. Sentencing Commission proposed changes to federal sentencing guidelines that would stiffen penalties for insider trading and give judges more guidance on calculating loss in mortgage and securities fraud cases. Panel member U.S. District Judge Jed Rakoff said federal sentencing guidelines have become progressively more punitive, despite the fact that the nature of white collar crimes has not significantly changed since 1987. Mark concurred with this sentiment, saying that judges were not following the guidelines because "the guidelines are too damn high," and the task of reforming them to be reasonable was probably impossible.
