Paul, Weiss Achieves Victory for Citigroup in Appeals Court
On October 12, Paul, Weiss obtained a victory on behalf of Citigroup Global Markets Inc. (Citigroup) when a federal appeals court upheld the lower court's decision to deny Braintree Laboratories Inc. (Braintree) a mandatory preliminary injunction in the form of a refund of money spent on auction rate securities in advance of arbitration on Braintree's securities fraud claims. A three-judge panel of the U.S. Court of Appeals for the First Circuit (consisting of Circuit Judges Michael Boudin and Jeffrey Howard, along with retired Justice David Souter, sitting by designation) also dismissed for lack of jurisdiction Braintree's appeal from the district court's order compelling arbitration of the dispute.
