July 20, 2022
Litigation partner Harris Fischman and counsel Steve Herzog co-wrote an analysis on the expansion of cyber-related SEC enforcement actions, published in the New York Law Journal on July 20. In “SEC’s Increased and Expanding Focus on Cybersecurity Disclosures,” the authors discuss the current state of cybersecurity enforcement; the SEC’s new proposed rulemaking on cyber incident-related disclosure obligations for public companies; and the various implications of this increased focus on cybersecurity for public companies. Litigation associate Emily Glavin assisted in the preparation of this article.
“While the Enforcement Division has historically focused its resources in this area on highlighting failures to disclose internal control deficiencies, the Division is beginning to cast a wider net in its investigations and enforcement actions,” the authors write.
