Today President Barack Obama announced his nomination of Christine A. Varney to serve as assistant attorney general in charge of the Antitrust Division of the Department of Justice. President Obama has promised that his administration will "reinvigorate antitrust enforcement." What this means as a practical matter remains to be seen. But some broad changes in antitrust enforcement policy -- especially in the areas of merger review and civil nonmerger enforcement -- can be anticipated under the new administration.
