In the episode, Nicole discusses why the ECJ recently annulled the European Commission’s decision to review Illumina’s acquisition of GRAIL under Article 22 of the European Merger Regulation, which the Court found does not allow the EC to review below-threshold mergers. She addresses alternative ways that the EC or EU member states could review transactions that fall below the threshold and how she is advising parties after the judgment.
