Temporary Restriction on Certain Commercial Rent Increases

On April 21, 2020, the Berkeley City Council unanimously passed an amendment to the COVID-19 emergency ordinance that prohibits landlords from increasing rent more than 10% over rates on March 10, 2020, for commercial tenants meeting the eligibility requirements below. This prohibition will be in effect until May 31, 2020, but may be extended.

Eligibility Requirements/Restrictions

The commercial rent increase restrictions apply to any business that had a business license in 2019 or 2020 in the City of Berkeley, or nonprofit that was registered both of those years, and: (1) whose operations have been shut down by the COVID-19 state of emergency, (2) that cannot accept customers at its current location and is open for limited, virtual, take-out or pickup services only, or (3) that has suffered a material loss of income.
