Description of Program and Relief

Eviction Moratorium

The City of Chula Vista has enacted a moratorium on (1) evictions of residential and commercial tenants for non-payment of rent, and (2) foreclosures for nonpayment of mortgages when a tenant’s or homeowner’s income has been substantially impacted by COVID-19 and that impact can be adequately documented. The moratorium does not waive or relieve tenants of their contractual obligation to pay unpaid rent that is due, meaning that landlords can seek unpaid rent. Affected renters must comply with written notice obligations, described below.

Effective immediately until July 31, 2020.

Eligibility Requirements/Restrictions

For the City’s eviction moratorium to apply, a tenant must provide written notice to the landlord within 30 days after the date rent is due that the tenant is unable to pay rent due to financial impacts caused by the COVID-19 pandemic.

Written notice may include email or text communications with a landlord or landlord’s representative or agent with whom the tenant has previously corresponded by email or text. Financial impacts includes, but is not limited to, lost household income as a result of any of the following: (1) sickness from COVID-19 or caring for a family or household member who is sick; (2) lay-off, reduction in hourly work, or other income reduction resulting from business closure or other economic or employer impacts of the COVID-19 pandemic; (3) compliance with an order from a government health authority to stay home, self-quarantine, or avoid congregation with others; (4) extraordinary out-of-pocket medical expenses; or (5) child care needs arising from school closures related to the COVID-19 pandemic.

The foreclosure suspension applies where a residential or commercial tenant is subject to eviction from a foreclosure proceeding where the basis of the proceeding arises from (1) a substantial decrease in household income or out-of-pocket, and (2) that either of these was caused by the COVID-19 pandemic.

Application Deadlines (If Applicable)

Written notice and relevant documentation must be provided to the landlord within 30 days after rent is due.
