Bankruptcy partner Brian Hermann and associate James Millerman's article, "Ad Hoc Attack," appeared in yesterday's Daily Deal. In the article, the authors explore recent divergent case law on the enforcement of a disclosure rule, which until recently had been little enforced, requiring significant disclosures from ad hoc (or unofficial) committees in bankruptcy cases and its possible chilling effect on such group participation in many large chapter 11 cases.
