Paul, Weiss counsel Corinna Yu and associate Cynthia Hu wrote an article titled, "Impact of New PRC Labor Contract Law on Employers," which appeared in the September 2007 issue of Asian Legal Business. The article looks at how employers in the PRC should review their existing employment contracts and policies to ensure compliance with the new PRC Labor Contract Law that takes effect on January 1, 2008. Key elements of the new Labor Contract Law are the requirement on employers to enter into written contracts with their employees and the push towards implementation of open-ended contracts rather than fixed term contracts. Employers will also be required to pay compensation to employees if employees are bound by non-compete obligations after the employees leave the service of their employers.
