Litigation partner Lew Clayton's "Patent Law" column appeared in the February 19 issue of The National Law Journal. The article reports on the U.S. Supreme Court's ruling in MedImmune, Inc. v. Genentech, Inc., which has stimulated debate on the rights of patent owners to discourage licensee challenges to patent validity or enforceability. The article raises questions on whether certain restrictions on challenges in license agreements should be enforced and provides thoughts on the future impact of the MedImmune ruling.
