Patent Law: 'eBay v. MercExchange'

Partner Lew Clayton's "Patent Law" column appeared in the April 17 National Law Journal. The article discusses eBay Inc. v. MercExchange LLC, a patent infringement case that was heard by the U.S. Supreme Court in late March. Lew explains that the central issue before the Court was "the extent to which trial judges will be afforded discretion to deny injunctions when a patent has been infringed." The case should be decided by the summer.
