February 9, 2009 Full PDF
Litigation partner Lew Clayton's Intellectual Property Law column appears in the February 9 issue of The National Law Journal. The article discusses the proliferation of standard-setting organizations (SSOs) responsible for developing industry standards. While standard-setting processes can lead to superior technologies, they also present opportunities for abuse. The article explores recent cases in which courts have considered the duties of SSO participants to disclose their ownership interests in intellectual property relevant to industry standards. Litigation associate Nader Hasan assisted in the preparation of this column.
