Nichia Prevails in Patent Infringement Suit

The District Court for the Northern District of California
dismissed with prejudice Bluestone Innovation LLC's claims of
infringement against Paul, Weiss clients Nichia Corporation and
Nichia America Corporation. Nichia Corporation is a Japanese
chemical engineering and manufacturing company that is the world's
largest supplier of light emitting diodes (LEDs). Nichia's LEDs are
used in displays, LCD backlighting, automotive and general lighting
applications.
In 2010, Bluestone filed a lawsuit alleging infringement of U.S.
Patent No. 6,163,557 by Nichia's LED products. Nichia did not pay
or provide any consideration for Bluestone's dismissal with
prejudice. The dismissal comes after Nichia obtained a favorable
claim construction order and subsequently filed for summary
judgment of non-infringement. The case originally involved a number
of LED companies, including Epistar Corporation, Formosa Epitaxy,
Huga Optotech Inc., Showa Denko K.K. and Toyoda Gosei Co., Ltd.,
among others, as defendants. Nichia was the only remaining
defendant through the claim construction portion of the case.
