Our team has a proven record of success in litigation involving ERISA law, pension and benefits, including cases where we have reduced our clients’ exposure by billions of dollars and precedent-setting matters where we have helped shaped law related to a variety of ERISA issues. Clients often look to us to handle novel ERISA disputes; for example, we recently won the dismissal of a first-of-its-kind ERISA lawsuit on behalf of Exxon Mobil Corporation alleging plan fiduciary liability for the business impacts of climate change. In 2015, we secured among the first dismissals of a multi-billion-dollar ERISA stock drop claim filed by pension plan fiduciaries following a Supreme Court decision that lowered the pleading standard, obtaining a ruling widely viewed as very favorable to the employer-fiduciary community. And in 2010, we were involved in one of the most significant actuarial malpractice litigations ever filed on behalf of the Alaska Retirement Management (ARM) Board, negotiating the largest such settlement ever for this type of claim.
